Code of Conduct for professionals and partners of the Jataí Institute

This document aims to establish clear values ​​and guidelines regarding expected behavior, as well as conflict of interest measures, for professionals at the Jataí Institute and its partners. It is based on OECD references, as well as best practices adopted by the Jataí Institute.

Principles

1. Attention to the public interest.
It is expected that Jataí's professionals and partners will maintain and strengthen trust in public institutions, demonstrating the highest standards of professional competence, efficiency, and effectiveness, upholding the Federal Constitution and laws, and striving to promote the public good at all times.

2. Transparency and accountability.
Jataí's professionals and partners are expected to use their powers and resources in accordance with the law and government policies, taking responsibility for their actions and decisions.Espera-se que os profissionais e parceiros da Jataí usem seus poderes e recursos de acordo com a lei e as políticas governamentais, assumindo responsabilidade por suas ações e decisões.

3. Integrity.
Jataí's professionals and partners are expected to make decisions that avoid private gain and are consistent with honesty and ethics.Espera-se que os profissionais e parceiros da Jataí tomem decisões que afastem a vantagem privada e sejam coerentes com a honestidade e ética.

4. Justice.
Jataí's professionals and partners are expected to make decisions and act fairly and equitably, without being influenced by personal biases, considering only the merits of the issue, valuing diversity and promoting an inclusive environment.

5. Continuous development.
Jataí's professionals and partners are expected to seek to improve their skills and knowledge, pursuing learning and professional development opportunities. They should be open to receiving feedback and constantly strive to improve their skills and performance.

General conduct

6. It is expected that Jataí's professionals and partners will maintain and strengthen trust in public institutions, demonstrating the highest standards of professional competence, efficiency, and effectiveness, upholding the Federal Constitution and laws, and striving to promote the public good at all times.

7. Professionals and public partners of Jataí should not solicit or accept gifts, favors, or other advantages from direct suppliers in bidding processes that are being planned or carried out.

8. Customs or practices may consider certain gifts and other perks as appropriate acts of courtesy, such as smaller gifts and conventional gestures of hospitality, in the form of modest invitations, coffee, low-value gifts, and promotional materials. However, it is generally accepted that:
a. The gift, even if symbolic, must be reported to direct leadership;
b. If there is any doubt as to whether the item qualifies as symbolic, the gift should be refused and reported to direct supervisors.
c. Invitations to receptions or promotional, cultural, sporting, or charitable events are subject to the same rules. Being on vacation is not a defense against the rules more broadly defined in this code. Professionals should under no circumstances solicit such invitations from a supplier.
d. Participation in professional seminars, visits, or trips can only be justified for purely professional reasons, with authorization from Jataí's leadership.

9. Throughout the entire planning, specification, and execution cycle of the purchase supported by Jataí, professionals and partners must demonstrate responsible behavior and seek transparent and collaborative decisions.

10. Jataí's partner professionals must ensure that they are never subject to the influence of suppliers.

11. Jataí's partner professionals should not disclose information to individuals outside the bidding process.

Information and conduct in the pre-bidding phase:

Jataí's professionals and partners may need to establish contacts with the private sector, as they benefit from acquiring technical knowledge about goods, services, and works from the market, in order to assess how contracts should be carried out and to develop bidding requirements more effectively.Os profissionais e parceiros da Jataí podem precisar estabelecer contatos com o setor privado, uma vez que se beneficiam ao adquirir conhecimentos técnicos sobre bens, serviços e obras advindos do mercado, a fim de avaliar como as contratações devem ser realizadas e elaborar requisitos de licitação de forma mais eficaz.

13. These contacts can occur through meetings or exchanges in public online environments with the goal of increasing market knowledge. Meetings should be conducted with as many suppliers as possible and, whenever possible, be publicly announced so that even those not previously identified can offer their contributions. Jataí's partner professionals must ensure that they are never subject to supplier influence.

14. Suppliers are interested in learning about public procurement in their field. To promote such exchanges, it is recommended to encourage exhibitions, workshops, trade fairs or forums with professional partners (local chambers of commerce, professional federations, unions, etc.).

15. In this context, the information that can be exchanged or disclosed refers to:
a. Information regarding completed procedures, once the contract has been finalized, is subject to the protection of confidential industrial and commercial information.
b. A description of public organizations and their public procurement processes.

16. To preserve equal treatment among suppliers, information regarding the estimated value of a project, the expected date of public consultation or publication of the tender, among other information relevant to the public body and the process in general, should not be disclosed to parties not involved in the process.

17. Any communication or information regarding a preliminary contract may only be disclosed through publicity or publication procedures defined in national legislation (e.g., public consultation).

18. The preparation of the purchase plan and specifications, in documents such as the Preliminary Technical Study and Terms of Reference, must consider that these documents are the responsibility of the public agency and that Jataí's professionals act only in providing technical support for decision-making.A elaboração do planejamento e especificação da compra, em documentos como Estudo Técnico Preliminar e Termo de Referência, deve considerar que esses documentos são de competência do órgão público e que os profissionais da Jataí atuam somente com suporte técnico para tomada de decisão.

19. Jataí's professionals can draft documents using documents from other bidding processes, information gathered from partners, and impersonal, public market research.

Information and procedures during the bidding process:

20. The management of the bidding phase is the responsibility of the public body. Jataí professionals may only contact the partner to support project management and offer technical assistance to overcome bottlenecks that impede the progress of the bidding process, always respecting the principle of public interest, equal treatment among candidates, and transparency of procedures.

Information and procedures in the post-bidding phase:

21. The management of the post-bidding phase is the responsibility of the public body. Partners should note that all decisions made must be based exclusively on the previously agreed contract provisions, especially regarding the definition and application of penalties. Partners should also note that the supervision and management of contract performance require collegiality and a documented record of decisions, particularly regarding penalties, performance certification, and potential contract amendments.
